National Practice Direction

May 21, 2007 - Update from Sandra Potter

The National Practice Directions for Ontario and Nova Scotia are pending. JTAC and Sandra Potter will advise CALSP when further information is obtained.

Justice McIntyre from Alberta has indicated that the Alberta version of the Practice Note (in Alberta they are Notes not Directions) will likely be signed by the end of May 2007. JTAC and Sandra Potter will advise CALSP once the Note has been officially signed.

I am writing on behalf of Chief Justice Brenner, who is chairing the Evidence Sub Committee of JTAC (Judges Technology Advisory Committee part of CJC), to ask for your assistance by posting the following to all your relevant staff, any appropriate bureau companies and members of the Canadian Association of Litigation Support Professionals:

The second draft of the national practice direction has been posted on the web at http://150.101.156.34/pdcanada and you are invited to provide your feedback on this document by downloading the feedback form, completing it as instructed and forwarding this feedback by email to pdcanada@potterfarrelly.com in accordance with the set timetable.

You will note in January there will be a series of workshops held which will provide an opportunity for you to come in person and give feedback. Dates for these workshops will be posted on the website by 20 December. It would be great if your feedback could focus on the Rules for the particular jurisdiction and the definition of terms such as “documents”.

I am writing on behalf of Chief Justice Brenner, who is chairing the Evidence Sub Committee of JTAC (Judges Technology Advisory Committee part of CJC), to ask for your assistance by posting the following to all your members:

The Canadian Judicial Council has approved a project to establish a national standard for the exchange and presentation of evidence in electronic form.

The proposed standard, which is based on the Practice Direction issued by the Supreme Court of BC on 1 July 2006, will be prepared after a series of consultative workshops facilitated by Sandra Potter, the international eCourt consultant engaged by the Council. The first phase of the project includes Ontario, Alberta and Nova Scotia, with other jurisdictions to follow. The goal is to have a national draft standard prepared for the consideration of Canadian Judicial Council by the end of February.

The standard will provide detailed guidance on the use of technology in civil litigation for lawyers and judges in particular in matters of the exchange of discovery documents and presentation of evidence in paperless trials. Upon the adoption of a national standard, parties and their Counsel will no longer have to face long delays and costs associated with the discovery process and presentation of this electronic evidence in Court.
